TERMS & CONDITIONS
In the following terms & conditions, "the photographer" shall mean Adree Chan trading as Adree Chan Photography. "The clients" shall be those people defined as purchasing the photography service from Adree Chan Photography. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in principle writing.
1. OWNERSHIP
i. The ownership of these Photos and Designs are the intellectual property of the photographer.
2. DISPLAY
i. The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc.
3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION
I. Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the client's requirements.
II. Special requests are not binding instruction, although every effort is made to comply with the client's wishes. The Photographer/s will do their best to honour the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather and the availability and willingness of subjects.
III. The photographer is not responsible for locations/entrance/ticket fees associated with accessing private venues which require booking/payment/license and reservations of these venues. It is the client's sole responsibility to book and pay for such private venue reservation. The client shall grant photographers from Adree Chan Photography with adequate access to these private venues. The area from which the photographer is able to cover in these private venues may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
IV. For a booking involving a church ceremony or at certain venues, the photographer's movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
V. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.
VI. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
4. PAYMENT
I. Standard Package (Outdoor or Studio Photoshoot) - A non-refundable booking fee, 50% of chosen package value will confirm your booking. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due.
II. In any case the client is not able to make the full payment of the agreed price and timeline for standard package, the photographer has the rights to refuse to provide any photographs services to the clients.
III. Pre-Wedding, Solemnisation, Actual Day Wedding-A non-refundable booking fee, 50% of chosen package value will confirm your booking. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due.
IV. Payment in full of the remaining balance will be due two weeks before the photoshoot/event or upon gown collection from our partner, whichever comes first.
V. For add on additional goods, customer must make the full payment upon ordering.
VI. Titles to all goods remain with the photographer until paid for in full by the client(s)
VII. Limited-Time Packages-The photographer may bundle special promotions together with the Standard Package and this will be known as "Limited-Time Packages". The availability of the "Limited-Time Packages" is stipulated by the photographer and has the right to change the "Limited-Time Packages" or replace with another package at his/her discretion. The "Limited-Time Packages" is subjected to a first-come-first-serve basis and to stock availability. The photographer has the sole right to modify or cancel this "Limited-Time Packages" anytime. The customer shall agree to this if any of the above were to happen and the "Limited-Time Packages" shall be defaulted to the Standard Package.
5. FORCE MAJEURE
i. In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid.
ii. The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, a victim of crime, natural disaster, traffic conditions, vehicle breakdown etc.
6. DIGITAL NEGATIVE FILES
i. All digital negatives (computer files) remain the property of the photographer. All digital wedding packages include a copy of the edited digital negatives to the client(s) for their own non-commercial use.
ii. Should the digital negative files be lost, damaged or destroyed for the reasons beyond control, the photographer's liability shall be limited to a full refund of any deposits and fees paid, but shall not include a refund for any goods already received.
7. ON THE DAY
i. Depending on the package and event coverage, there could be single/multiple professional (still) photographer at the venues specified. The photographer does however positively encourage family, friends and other guests to take photographs throughout the day.
ii. The photographer will not take photos after the agreed booking hours. If there is a need to extension in the booking hours the client will need to communicate the photographer 24 hours in advance before the shoot or in writing. It is in the sole discretion of the photographer to decide if the extension is allowed and the client will be charged accordingly.
8. PERSONAL ACCIDENT
i. Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
9. RESCHEDULING & CANCELLATION FEES
I. If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:
II. In the event of any cancellation two week prior to the agreed event venue, date and time, the booking fee 50% of chosen package value will be forfeited.
III. Cancellation with less than two weeks to go until the event date, full price for the complete photographic coverage booked. The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.
IV. If the client(s) should have to reschedule a booking, two weeks' notice before the scheduled date should be given with no rescheduling fee. Rescheduling less than two weeks' notice before the scheduled date, the booking fee (50% of chosen package value) will be forfeited. A new booking is required (Subjected to availability).
V. In the event of rescheduling due to Covid-19 or government restrictions, there will be no rescheduling fee.
VI. Only one time of rescheduling is allowed.
VII. The client will accept any cancellation or rescheduling of date due to unforeseen events from the photographers.
10. DELIVERY
i. The photographer will endeavour to deliver digital negative files as quickly as possible. However, this could take up to 4-6 weeks during busy periods.
